Murata’s approach for California Proposition 65

Its goals are to protect drinking water sources from toxic substances that cause cancer and birth defects and to reduce or eliminate exposures to those chemicals generally, such as consumer products, by requiring warnings in advance of those exposures. The first statutory requirement of Proposition 65 prohibits businesses from knowingly discharging listed substances into drinking water sources, or onto land where the substances can pass into drinking water sources. The second prohibits businesses from knowingly exposing individuals to listed substances without providing a clear and reasonable warning. An official list of substances covered by Proposition 65 is maintained and made publicly available. Chemicals are added to or removed from the official list based on California's analysis of current scientific information.

In , California voters approved an initiative to address the concern of exposure to toxic chemicals. This law was supposed to regulate toxic chemicals that already existed as well as new chemicals that came into production. However, this act did not function as intended. It grandfathered in thousands of existing chemicals without checking them and could not keep up with the regulation of new chemicals. Overall, it was only able to ban a very small number of toxic substances. People did not feel protected under this act and wanted better regulations.

Proposition 65, also known as the Safe Drinking Water and Toxic Enforcement Act of , is designed to protect the public from exposure to toxic chemicals in their drinking water, the environment and in the products they purchase. Proposition 65 requires the state of California to publish a list of chemicals toxic to reproductive health, or known to cause cancer and birth defects, that is updated annually. Businesses operating or selling in California must notify the public about the presence of significant amounts of these chemicals in their homes, workplaces and in the products they purchase. The onus is placed on businesses operating in California to notify the public about potential exposure to the chemicals on the toxic substances list. Once a chemical has been added to the list, businesses must comply with certain warning requirements within 12 months of the date it was added. Companies who do business in California are also prohibited from knowingly discharging any of the listed substances into drinking water sources.

No person in the course of doing business shall knowingly discharge or release a chemical known to the state to cause cancer or reproductive toxicity into water.
